1.Legal information and consent

These provisions regulate the use of the internet portal service (henceforth, the “Portal”) which Rafael Medina Abogados, S.L (also, Medina Pinazo Abogados) makes available to users of the internet. The headquarters of Rafael Medina Abogados, S.L. can be found in Calle Alarcón Luján, 1, 1º, and C.I.F. number B-92665751 (VAT identification number).

Access to the website is free, with the exception of any charge you may receive through the telecommunication network supplied by the internet access provider contracted by users. The legal services provided by the firm generally correspond to the price indicated in the corresponding commercial offer, and under no circumstances are offered or provided simply by the use of the Portal.

The use of the Portal is conditional on the Portal user (henceforth, the “User”) fully accepting all the conditions included in this legal notice. The User must read this legal notice on each occasion they wish to use the Portal due to any modifications the terms of use in this legal notice may undergo.     

2.Industrial and intellectual property

All contents of the Portal, which include by way of example, but not exclusively: texts, pictures, graphs, images, icons, technology, software, links and other audiovisual or sound contents, as well as its graphic design and source code (henceforth, the “Contents”), are the intellectual property of Medina Pinazo Abogados or any possible third parties, and it therefore does not imply that the User is granted any of the exploitation rights covered in the existing regulations on the subject of intellectual property, with the exception of those strictly necessary for use of the Portal. Trademarks, commercial names or any distinguishing marks are owned by Medina Pinazo Abogados or third parties. Nothing contained on the Portal may be construed as granting any right to use the aforementioned trademarks, commercial names and/or distinguishing marks.

  1. Terms and conditions of the Portal

3.1 General

The User is hereby bound to make correct use of the Portal in accordance with the law and this legal notice. The user will be liable to Medina Pinazo Abogados, or any third party, for any damages that could be caused as consequence of the non-fulfillment of said obligation. It is expressly forbidden to use the website for illicit or harmful purposes against Medina Pinazo Abogados or any third party, or in any way overload, damage or disable the networks, servers and other IT equipment (hardware) or products and IT applications (software) of Medina Pinazo Abogados or any third party.

3.2 Contents

The User agrees to use the Contents in accordance with the law and this legal notice, as well as with the other conditions, regulations and instructions which could be applicable in accordance with the first clause. The User, in accordance with the current legislation, should refrain from: reproducing, copying, distributing, making available, communicating publicly, transforming or modifying any of the Contents, with the exception of cases authorized by law, or expressly consented by Medina Pinazo Abogados or the owner of the exploitation rights.

In accordance with the current legislation regarding intellectual property, users are not to reproduce or copy Contents for private use that may be considered as Software or Database, nor are Users to communicate publicly or make available said Contents when these actions necessarily imply the reproduction by the User or third party. It is also forbidden to extract and/or reuse all or a substantial part of the Contents of the Portal, as well as any databases Medina Pinazo Abogados makes available to the Users.

 

  1. Exclusion of liability

4.1 Information provided

Access to the Portal does not imply any obligation on the part of Medina Pinazo Abogados to verify the truthfulness, accuracy, suitability and thoroughness of the information provided. The Contents of this page are of a general nature and do not constitute, under any circumstances, the provision of any type of legal advice. Therefore, said information must not be used by the User to make any personal or business decisions. Medina Pinazo Abogados is not responsible for any decisions taken based on the information provided in the Portal, or for any damages the User or any third party suffers as a result of the information obtained through the Portal.

4.2 Quality of service

Access to the Portal does not imply any obligation on the part of Medina Pinazo Abogados to control the absence of viruses, computer worms or any other harmful computer science elements. Users should use adequate tools to detect and disinfect any harmful computer programs. Medina Pinazo Abogados is not responsible for damages caused to any computer systems owned by the User or any third party while using the Portal.

4.3 Availability of service

The access to the Portal requires the services and provisions of third parties, including going through communication networks of which the reliability, quality, continuity and running does not correspond to Medina Pinazo Abogados. Consequently, the services provided through the Portal can be suspended, cancelled or made inaccessible prior to, or during, the use of the Portal. Medina Pinazo Abogados is not responsible for damages of any type which the User can suffer resulting from failure or outage of telecommunications networks, which may result in the suspension, cancellation or interruption of the Portal service prior to, or during, its use.

4.4 Content and services linked through the portal

The service for access to the Portal includes technical link mechanisms which enable the User to access other websites through the Portal (henceforth, “Linked Sites”). In these cases, Medina Pinazo Abogados acts as a provider of brokerage services in accordance with Article 17 of Law 34/2002, from July 12, Information Society Services and Electronic Commerce (LSSI), and as such can only be held accountable for the content and services provided on the Linked Sites, to the extent that it has actual knowledge of its unlawful nature and has not acted. If the User believes that a Linked Site contains unlawful or inappropriate information, they can contact Medina Pinazo Abogados in accordance with the procedure and practices established in clause 6, although in no case does such notification impose any obligation to remove the link in question.

Under no circumstances should the existence of Linked Sites presuppose the existence of any agreements with the owners or the people responsible for said websites, or the recommendation, promotion or identification of Medina Pinazo Abogados with the declarations, contents or services provided.  Medina Pinazo Abogados is not aware of the content and services provided by the Linked Sites, and therefore is not responsible for any damage caused by the unlawfulness, quality, unavailability, error or uselessness of the content and/or services provided by the Linked Sites or any other damage that is not directly attributable to Medina Pinazo Abogados.

 

  1. Protection of personal data

Medina Pinazo Abogados complies with the security standards required by the Regulation of Security Measures, passed by the Royal Decree 1720/2007 of December 21, approving the Development Regulation of Organic Law 15/1999, of December 13, the Protection of Personal Data. Nevertheless, technical safety is never absolute and the possibility of leaks due to damaging third parties exists.

Medina Pinazo Abogados may use cookies during the use of the Portal service. Cookies are automatic procedures for collecting information relative to the preferences determined by a user during their visit to the website. This information is registered in small files which are then saved on the computer system of the corresponding user. Each time the user returns to visit the website in question, these files activate automatically in a way which configures the website with the preferences used in previous visits. Ultimately, cookies are text files placed on your hard drive which store personal information and are explicitly associated with this terminal. Cookies do not read cookie files created by other providers. The User has the possibility of configurating their browser in a way that prevents the creation of cookie files, or an alert will appear the moment this occurs. The Portal is accessible without the need to activate the options relating to cookies, but puts at risk the proper functioning of the security features for exclusive services or services that require a greater deal of security. As a general rule, the purpose of the Portal’s cookie files is to make navigating the Portal easier for the User.

 

  1. Notice of unlawful and inadequate activities

Should the User or any third party have knowledge of any illicit, harmful, degrading or violent content within the Linked Sites, they should contact Medina Pinazo Abogados providing the following information: personal details (name, address, contact number and email); facts or circumstances revealing the illegality of the Linked Site; should any violation of intellectual or industrial rights occur, the personal information of the owner of the right that has been infringed (provided said person is different from the informant themselves). Proof of the owner of the right’s entitlement must be provided and, when necessary, their capacity to represent on behalf of the owner when it is someone different to the informant. Affirmation that the information contained in the claim is accurate is also necessary. Receiving of any aforementioned communication by Medina Pinazo Abogados does not imply any knowledge of the activities and/or contents indicated by the informant.
